the action of the respondent-police in booking successive First Information Reports in various police stations for the very same set of facts is wholly illegal, that once a crime is registered basing on a complaint and investigation is commenced, all the subsequent complaints with regard to the same set of facts be treated as statements under Section 162 of Cr.P.C. even though they are registered as crimes as per the decision of the Apex Court, that the police officer concerned has already transferred one of the cases to C.B.C.I.D. for investigation, and that it is reported that the aggrieved parties were directed to lodge complaints before the C.B.C.I.D.

            HON'BLE SRI JUSTICE RAJA ELANGO

            CRIMINAL PETITION Nos.14079, 14080, 14081, 14082 of 2011 and 428, 429 of 2012

COMMON ORDER:
Since parties to the proceedings are one and same and the point to be decided is also one and same, all the criminal petitions are being disposed of together by this common order.
The offences alleged against the petitioner are punishable under Sections 406, 420, 506, 120-B of IPC and Section 5 of the A.P. Protection of Depositors of Financial Establishments Act 1999.
After arguing for some time, learned counsel for the petitioner has submitted that the action of the respondent-police in booking successive First Information Reports in various police stations for the very same set of facts is wholly illegal, that once a crime is registered basing on a complaint and investigation is commenced, all the subsequent complaints with regard to the same set of facts be treated as statements under Section 162 of Cr.P.C. even though they are registered as crimes as per the decision of the Apex Court, that the police officer concerned has already transferred one of the cases to C.B.C.I.D. for investigation, and that it is reported that the aggrieved parties were directed to lodge complaints before the C.B.C.I.D.
Considering the submission of the learned counsel and in the facts and circumstances of the cases, the officer concerned, before whom one of the cases is transferred, is hereby directed to treat the other cases registered in various police stations as also the fresh complaints in connection with the same transaction as statements of other aggrieved persons and investigate the matter as one case and file a final report either way before the Court concerned.
With the above direction, all the Criminal Petitions are disposed of and miscellaneous petitions, if any, filed shall stand closed.
